New Haven’s Laws

  1. Haven must be governed by a leading Monarch and Council.
    1. During council proceedings the Monarch does not have a vote.
      1. During council sessions, to prevent royal influence, the ruling Monarch may not vote.
      2. Should the council end in a tie breaker, then the Monarch may make the tie breaker vote.
    2. The leading Monarch may be removed by a passing vote of no confidence from the council.
      1. A vote of no confidence may be initiated by any council member.
      2. The councilor proposing the vote of no confidence must have a proposed replacement.
      3. The Council holds the right to reject proposed replacement should the no confidence vote pass.
      4. The majority determines the success or failure of the vote of no confidence.
      5. In the case of a stale mate, a neutral third party may be called as a tie breaker.
      6. Should a tie breaker not be used, the vote fails to pass.
    3. The leading Monarch may take executive power in times of war.
      1. Times of War is considered only after a valid declaration of war is given.
      2. Declarations of war can only be made by majority vote of the council.
      3. Should a declaration of war vote pass, the ruling Monarch must make a public announcement to the populous.
      4. Should the ruling Monarch decide to take executive power, they must inform the council prior.
      5. Should the ruling Monarch decide to take executive power a valid reason must be given.
    4. The council must be made up of at least four (4), but up to ten (10), councilors.
      1. All allies have a right to elect a representative to the council to speak on their interests.
      2. All council members are to be elected officials.
      3. All councilors hold the right to have aides present at proceedings.
      4. Any council member may be revoked of their position by majority vote.
      5. The majority determines the success or failure of the vote.
      6. In the case of a stale mate, a neutral third party may be called as a tie breaker.
      7. Should a tie breaker not be used, the vote fails to pass.
      8. Should a proposal for removal be passed, a replacement must be elected within six (6) months.
  2. Haven will erect and maintain refugee centers throughout the galaxy.
    1. Refugee centers must be non-descript.
      1. There shall be no identifying markers on the outside of the center.
      2. Any outgoing transmissions from the refugee center must be made on a secure and encrypted channel.
      3. All systems must be untraceable to Haven.
    2. Refugee centers must not turn away anyone.
      1. There shall be no discriminatory practices based on species, religion, gender, or previous allegiances.
      2. All those seeking refugee status must be given sleeping arrangements, food, and water in regular intervals.
      3. Families must not be separated, except in the case where danger may be present to one or more of the family members should they remain in close quarters.
    3. Refugees must go through extensive background checks.
      1. These checks include but are not limited to: Name, Age, Species, Gender, and former employment.
      2. All refugees must answer the refugee questionnaire.
      3. Asylum determination must be based off of the previously mentioned questionnaire.
    4. Transport from Refugee centers to Haven space must be provided.
      1. Refugees are permitted to use personal ships should they be available.
      2. In the case that personal ships are not available transportation will be provided by Haven on a weekly basis from the refugee centers to Haven space.
      3. All travel costs must be paid for by Haven’s government.
  3. Haven must aid all seeking it.
    1. Individuals
      1. Individuals must be referred to a refugee center if outside of Haven space.
      2. Individuals who have made it to Haven space must be referred to the Hope or Kajuuti Central Government Building for processing.
    2. Families
      1. Families outside of Haven space must be referred to a refugee center.
      2. Families must not be split up unless required for their safety.
      3. Families that have made it to Haven space must be referred to the Hope or Kajuuti Central Government Building for processing.
    3. Communities.
      1. Haven must provide the means for the community to enter Haven space.
      2. Haven must provide any required protection to the refugee community.
      3. Any community moving to Haven space must agree to mutual defense.
  4. Haven must be strictly anti-slavery.
    1. Any work done for Haven or within Haven’s borders must be given fair wages.
      1. Wages may not be withheld for any reason.
      2. Private companies have a right to determine their employees wages as long as they are equal to or higher than the stated minimum wage.
      3. Minimum wages must be reevaluated annually to ensure citizens are receiving a livable wage.
      4. Small businesses may apply for wage subsidization from the government, covering employee wages in the case of lack of money flow.
    2. Haven reserves the right to interfere with slave trading practices, liberating slaves as they see fit.
      1. Slave traders are not permitted in Haven space at any time.
      2. Slave traders are considered hostile entities and will be treated as such.
      3. Raids on slavery sites are permitted and encouraged.
      4. Civilian casualties during raids or hostile engagements must be kept at a minimum.
    3. Any individual practicing slavery in Haven space is subject to imprisonment
      1. Suspects are innocent until proven guilty.
      2. Those arrested for slavery have a right to an attorney.
      3. Those arrested for slavery have a right to a fair trial.
      4. Capital punishment is not available for slavery violations.
      5. There shall be a minimum punishment of 10 years imprisonment, and a maximum punishment of 40 years imprisonment for those determined guilty of slavery practices.
  5. Treaties and alliances must be strictly upheld.
    1. Treaties must be signed by the Monarch.
      1. The Monarch may not sign without council approval.
    2. Treaties must be approved by council vote.
      1. Should any part of a proposed treaty go against any stated laws, it automatically fails.
      2. The majority determines the success or failure of the vote.
      3. In the case of a stale mate, a neutral third party may be called as a tie breaker.
      4. Should a tie breaker not be used, the vote fails to pass.
    3. All sections and subsections of any treaties must be strictly upheld.
      1. Violations from those within Haven will be a punishable offence.
      2. Retribution for failure to comply with treaties from outside of Haven is permitted.
      3. Retributions for failure to comply with treaties must be strictly outlined in the treaty.
  6. Legal proceedings must take place in a fair manner.
    1. Criminal suspects rights.
      1. Suspects have the right to legal representation.
      2. Suspects have the right to remain silent.
      3. Suspects have the right to a fair trail.
      4. Suspects have the right to appeal any decision made by the court.
      5. Suspects have the right to make counter arguments at trial.
      6. Suspects have the right to present a character witness.
      7. Suspects have the right to present witnesses.
      8. Non violent offenders have the right to be released on their own reconnaissance until trial.
      9. Suspects may forfeit any of these rights at any time.
    2. Criminal Victims rights.
      1. Victims have the right to remain safe, should their safety be in question appropriate safeguards will be provided.
      2. Victims have the right to appear at trial.
      3. Victims have the right to present witnesses.
      4. Victims have the right to appeal any decision made by the court.
      5. Victims have the right to legal representation.
      6. Victims have the right to speak at trial.
      7. Victims may forfeit any of these rights at any time.
    3. Civil defendants rights.
      1. Defendants have the right to legal representation.
      2. Defendants have the right to a fair trial.
      3. Defendants have the right to present character witnesses.
      4. Defendants have the right to admit evidence to the court.
      5. Defendants have the right to appeal any decision made by the court.
    4. Civil Plaintiffs rights.
      1. Plaintiffs have the right to legal representation.
      2. Plaintiffs have the right to a fair trial.
      3. Plaintiffs have the right to present character witnesses.
      4. Plaintiffs have the right to admit evidence to the court.
      5. Plaintiffs have the right to appeal any decision made by the court.
    5. Court’s rights.
      1. The court holds the right to determine the outcome of a trial.
      2. The court holds the right to remove individuals from the premises if their presence is causing unfairness or distractions within the court.
      3. The court holds the right to determine minimum and maximum sentences.
      4. The court holds the right to prosecute individuals for contempt of court.
  7. Inmate rights and duties
    1. Inmate rights.
      1. Inmates have the right to safe housing within the prison.
      2. Inmates have the right to meals and water at regular intervals.
      3. Inmates have the right to clean clothing and the means to clean them.
      4. Inmates have the right to work, any earnings placed into escrow for later use or applied to their inmate account.
      5. Inmates have the right to see visitors in compliance with the facility.
      6. Inmates have a duty to uphold the rules and regulations of the facility.
      7. Inmates have a duty to maintain the cleanliness of their quarters.
      8. Inmates have a duty to report any contraband inside of the facility.
  8. Treason.
    1. What is considered treason
      1. Assaults on Haven controlled facilities
      2. Giving out classified information to other factions.
      3. Giving out specs about any facility to the enemy.
      4. Attempted assassinations.
    2. Treason is punishable by imprisonment or execution.
      1. In severe cases, especially with major loss of life, capital punishment shall be used.
      2. In mild cases, the traitor will be sentenced to life imprisonment.
      3. Exceptions are to be given for those under blackmail or chemical/force control methods.
  9. Haven shall provide citizens basic living requirements, free of charge.
    1. Housing.
      1. Citizens have the right to free housing based on their needs.
      2. Should a citizen prefer to have housing larger than that based on their needs they are required to pay the difference. The difference may be paid in interest-free installments or outright.
      3. Any repairs to housing is the responsibility of the resident, unless the repair is life threatening should it be put off.
      4. All utilities are the responsibility of the resident, unless the resident does not have the means to pay then it is subsidized by the Government
    2. Medical.
      1. Citizens have the right to free medical care.
      2. Citizens may subsidize any medical care received outside of Haven space by submitting the invoice to the government.
      3. Mental health services are considered medical care.
      4. All medical facilities in Haven Space will have all wages and supplies covered in full by the government.
    3. Legal.
      1. Citizens have a right to access legal aid.
      2. All legal aid is paid in full by the government.
      3. All attorneys in Haven space must pass a certification exam to be allowed to practice.
      4. Citizens have a right to private mediators.
      5. All costs incurred from private mediation are paid in full by the government.
      6. Citizens requiring legal representation outside of Haven space have a right to Haven legal representation.
